Dale & Newbery secure £1.25m for personal injury client

A young man who suffered life-changing injuries when a roof panel struck him during a storm has settled his case for £1.25m after Dale & Newbery’s legal intervention.

Craig Taylor represented him, following a recommendation to our Personal Injury & Clinical Negligence department.

At the time of the accident the claimant was planning to go to university but his injuries have led to him having to change his plans.

The claim was a complex one in terms of liability, as the building concerned had only recently been refurbished, with numerous contractors and sub-contractors involved. It meant there were a number of potential defendants identified and investigated.

After a forensic examination of a great deal of documentation that had been disclosed, the potential defendants were finally brought down to 2, who both doggedly denied the accident was their fault.

While these investigations were on-going, steps were also undertaken to obtain expert evidence from different medical experts, to take account of the complex nature of the injuries sustained by the claimant.

As liability remained in dispute proceedings were issued against both defendants that had been identified and the matter was transferred to the High Court, due to the complexity of the issues involved and the potential value of the claim.

A trial had been set for June this year, but the defendants finally accepted liability, having reached agreement between themselves on this issue, and the claim then quickly settled for £1.25m.

Although the claim has settled, as part of Dale & Newbery’s on-going support for the claimant, we provided him with recommendations to seek independent financial advice and for the appointment of a case worker to assist with his future needs.

At the conclusion of the claim the claimant was kind enough to write to Mr. Taylor, saying “…it was a great pleasure to deal with an experienced solicitor who is characterized by such professionalism at its best…”

While no amount of money can ever truly compensate a claimant for the injuries and consequential losses suffered in an accident such as this one, the sum recovered will at least make the rest of this young man’s life more tolerable and allow him to undergo the rehabilitation and secure the support he requires in the future.
